Welcome to AIPetz! These Terms of Service ("Terms") govern your access to and use of AIPetz's AI-powered pet image and video generation service (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

2. Service Description

AIPetz provides an AI-powered platform that allows users to:

• Upload photos of themselves and their pets
• Provide AI Services: Process your photos using AI models to generate realistic pet scenes, 3D animated style images, stylized avatars, and animated videos
• Create animated videos of their pets
• Share creations with the community
• Purchase credits for AI generation services

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. Account Registration and Security

3.1 Account Creation

• You must sign in using a valid Google account
• You must be at least 13 years old to use the Service
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account

3.2 Account Responsibilities

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Do not share your account credentials
• One account per person

4. User Content and Intellectual Property

4.1 Your Content

You retain all ownership rights to the photos you upload. By uploading content, you represent and warrant that:

• You own or have the right to use all uploaded photos
• Your content does not violate any third-party rights
• Your content complies with all applicable laws
• You have consent from any individuals depicted in your photos

4.2 License to AIPetz

By uploading content, you grant AIPetz a worldwide, non-exclusive, royalty-free license to:

• Process your photos using AI technology
• Store your content on our servers
• Display your AI-generated content publicly (only if you choose to share it)
• Use your content to improve our AI models and services

4.3 AI-Generated Content

You own the AI-generated images and videos created from your uploads. However, AI-generated content is created using our proprietary AI models and technology. You may use your generated content for personal and commercial purposes.

5. Prohibited Uses

You agree NOT to:

• Upload illegal, harmful, threatening, abusive, or offensive content
• Upload photos of people without their consent
• Upload copyrighted material you don't own
• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer or copy our AI technology
• Abuse, harass, or harm other users
• Upload sexually explicit or inappropriate content
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Use automated tools to access the Service without permission

Violation of these terms may result in immediate account termination and legal action.

6. Credits, Payments, and Refunds

6.1 Credit System

• Credits are required to generate AI content
• Credit costs vary by generation type (images, videos, 3D avatars)
• Credits never expire
• Credits are non-transferable

6.2 Payments

• All payments are processed securely through Stripe
• Prices are subject to change with notice
• You are responsible for all applicable taxes
• Subscription packages auto-renew unless canceled

6.3 Refund Policy

We offer a satisfaction guarantee:

• If you're not satisfied with your first generation, contact us within 24 hours for a full refund
• Refunds for subsequent purchases are evaluated on a case-by-case basis
• No refunds for used credits or completed generations

7. Disclaimer of Warranties

We specifically disclaim:

• Quality Guarantees: AI-generated results may vary in quality and accuracy
• Availability: Service may be interrupted or unavailable
• Accuracy: AI may not perfectly replicate your vision
• Fitness for Purpose: Results may not meet your specific expectations

AI technology is inherently unpredictable. While we strive for high-quality results, we cannot guarantee that every generation will meet your expectations.

8. Limitation of Liability

Our total liability shall not exceed:

• The amount you paid to AIPetz in the 12 months preceding the claim, OR
• $100 USD, whichever is greater

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

9. Indemnification

You agree to indemnify, defend, and hold harmless AIPetz, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your uploaded content
• Any misuse of AI-generated content

10. Content Moderation and Removal

We reserve the right to:

• Review and moderate all user content
• Remove content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal activity to authorities
• Refuse service to anyone for any reason

We are not obligated to monitor content but may do so at our discretion.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting woof@aipetz.ai. Unused credits are non-refundable upon termination.

11.2 Termination by AIPetz

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account is inactive for extended periods
• We discontinue the Service

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on this page
• Updating the "Last Updated" date
• Sending email notifications for significant changes
• Requiring re-acceptance for material changes

Your continued use after changes constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13.2 Dispute Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting woof@aipetz.ai. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

13.3 Arbitration

Any disputes shall be resolved through binding arbitration rather than in court, except for small claims court actions. You waive your right to a jury trial.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIPetz.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.
